Terms of Use
These terms govern your use of the Staydays iOS application and the staydays.app website (together, the Service). The Service is operated by milaapps ("we"). By downloading the app or using the site, you agree to these terms. If you do not agree, do not use the Service.
1. The Service
Staydays records which country, and which US state, you are in each day, using your device location and the trips you enter, and applies day-count rules such as the Schengen 90/180 rule and 183-day residency thresholds. The website provides related guides and free calculators that run in your browser. How we handle data is described in the Privacy Policy, which is part of these terms.
2. Accuracy: an informational tool, not advice
Staydays and the calculators on this site are informational tools. They do not provide legal, tax, or immigration advice, and their day counts are estimates, not official records.
Counts can be wrong or incomplete for ordinary technical reasons: the location permission you granted, background app refresh being off, Low Power Mode, airplane mode, poor connectivity, time-zone changes, or days when the device was off. Border days in particular can land on either side of midnight. Rules themselves also change and vary by nationality, visa status, and facts the app cannot know.
You are responsible for verifying your own compliance with immigration and tax rules. Check the app's day log against your passport stamps, tickets, and other records before relying on it, and consult a qualified advisor for decisions that depend on residency or visa status. Where the app's count and an official record disagree, the official record prevails.
3. License
We grant you a personal, non-exclusive, non-transferable, revocable license to use the app on Apple-branded devices that you own or control, as permitted by the App Store terms, including the standard Apple Media Services terms. milaapps and its licensors own all intellectual property in the Service. You may not copy, modify, distribute, sell, rent, or reverse engineer the Service, or create derivative works from it, except where applicable law permits this despite the restriction.
4. Subscriptions and billing
The app is free to download; a paid auto-renewing subscription adds premium features. All billing is handled by Apple through your App Store account. We never see or store your payment details.
- The subscription renews automatically unless you cancel at least 24 hours before the end of the current period.
- Manage or cancel it any time on your device in Settings, under your Apple ID, Subscriptions. Deleting the app does not cancel the subscription.
- If the price changes, Apple notifies you in advance and, where required, asks for your consent before the new price applies.
- Where a free trial is offered, any unused portion is forfeited when you purchase a subscription.
- Refunds are handled by Apple under its App Store policies. Request one at reportaproblem.apple.com.
5. Your data and backups
Your location history and day log are stored on your device and in your private iCloud, as described in the Privacy Policy. We hold no copy, so we cannot restore your data if you delete it. Keep iCloud sync on, or export your reports, if you want a backup.
6. Acceptable use
Do not misuse the Service. In particular, you may not attempt to gain unauthorized access to any part of it, interfere with its operation, use it to break any law, or present the app's outputs to any authority as if they were official records.
7. Warranty disclaimer
The Service is provided as is and as available, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not promise that day counts will be accurate or complete, that the Service will be uninterrupted or error-free, or that defects will be fixed. Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.
8. Limitation of liability
To the maximum extent permitted by law, milaapps is not liable for indirect, incidental, special, consequential, or punitive damages, nor for fines, penalties, denied entries, visa refusals, overstay consequences, tax assessments, or other losses that arise from relying on the Service. Our total liability for all claims relating to the Service is capped at the amount you paid for it in the twelve months before the claim arose. Nothing in these terms limits liability that cannot be limited by law, including your mandatory consumer rights and liability for intent or gross negligence where the law preserves it.
9. Termination
You can stop using the Service at any time by deleting the app. We may suspend or end your access, or discontinue the Service, if you breach these terms or if we retire the product. Sections 2, 7, 8, and 10 survive termination. Any active paid subscription remains subject to Apple's billing and refund policies.
10. Governing law
These terms are governed by the law of the Netherlands, excluding its conflict-of-law rules. If you are a consumer, the mandatory consumer protection law of your country of residence still applies, and nothing here takes away your right to bring claims before your local courts where the law grants it.
11. Changes to these terms
We may update these terms. Changes take effect when posted on this page, with the dates above adjusted. Material changes will also be noted in the app's release notes. Using the Service after a change means you accept the updated terms; if you do not, stop using the Service and cancel any subscription.
